This will depend on whether or not the tenant has breached any of the terms of the Tenancy Agreement. If the tenant is in breach of the Tenancy Agreement then we can consider serving a Section 8 Notice in accordance with the Housing Act 1988. If the tenant has not breached any of the terms of the Tenancy Agreement then we can consider serving a Section 21 Notice in accordance with the Housing Act 1988, this Notice is often referred to as a “non-fault” Notice.

The time period each of those notices give can vary, and if the tenant doesn’t vacate you will need to apply to court. The perils of getting the process wrong are important if you don’t want to fall foul of the rules.
